This article aims to provide a semiotic analysis of environmental law and youth protests. More precisely, drawing on speech act theory this article regards both as types of communication and teases out the inherent voice and message, specifically with regard to the interests of future generations. The argument unfolds in three steps. First, the article looks into speaker and speech of environmental law and argues that it speaks, as legislation does, in the first-person plural voice of a ‘we’. Second, the (...) article examines a speech of Greta Thunberg through the lens of Stanley Cavell’s theory of passionate utterances. This interpretation will unlock the political stakes of Thunberg’s speech as she claims standing with those responsible for enacting environmental law. Finally, the consequences of this reading will be analysed by relating message and voice of environmental law. As youth protests question ordinary forms of political representation, new ways of safeguarding the interests of future generations are called upon. (shrink)

Crowdfunding is regarded a financing mechanism that could improve the funding opportunities of businesses with a pro-social orientation. Indeed, it is assumed that on digital platforms, citizens are inclined to provide more support to projects with a social benefit than to those without such an orientation, with significant ethical implications for the common good. Yet, extant empirical evidence regarding such a claim is still inconclusive. To advance this discussion, the present paper analyzes the conditions that influence crowd support for projects (...) displaying a pro-social orientation on a reward-based crowdfunding platform. To build our hypotheses, we adopt the lens of framing theory, and we relate it to the digital context. Beginning from the premise that, on crowdfunding platforms, information about projects has a hierarchical structure, we argue that a project’s success crucially depends on how much its proponent emphasizes the pro-social cues within this structure. Moreover, we propose that because pro-social cues demarcate a project over others, the effectiveness of pro-social framing is enhanced when the number of projects on the platform, i.e., its crowdedness, increases. Logit estimates on 8631 Kickstarter projects indicate that pro-social framing is positively associated with success as we expected, yet only when it is moderately emphasized. Further, we find that crowdedness on the platform positively moderates the effect of pro-social orientation on success. (shrink)

Ulrich Beck characterized the transition from modern to late modern society as a shift from an industrial to a “risk society.” Contemporary society is challenged by negative side effects of modernization, including the increasing and imminent threat of global climate change. This article will test the validity of conceivable prescriptive elements associated with this sociological theory. In doing so, it will focus on the most recent legal developments aimed at tackling climate change within the EU. This paper finds that the (...) precautionary approach is unable to sufficiently shape balanced legal intervention in this day and age. In this paper we compare the strategies applied by two successful biological components of the ecosystem, the viruses and the human beings, to interact with the environment. Viruses have had and still exert deep and vast actions on the ecosystem especially at the genome level of most of its biotic components. We discuss on the importance of the human being as contraptions maker in particular of robots, hence of machines capable of automatically carrying out complex series of actions. Beside the (...) relevance of designing and assembling these contraptions, it is of basic importance the goal for which they are assembled and future scenarios of their possible impact on the ecosystem. We can’t procrastinate the development and implementation of a highly inspired and stringent “ethical code” for human beings and humanoid robots because it will be a crucial aspect for the wellbeing of the mankind and of the entire ecosystem. This article discusses how the persistence of child labor, especially in Brazil and the United States of America, constitutes a current facet of neo-colonialism. Cultivated as an educational and dignifying activity, exploited child labor persists and is naturalized. Schools, religions, and the legislation contribute to making the working class come to love and naturalize what in the past was understood as torture and punishment, thus jointly acting as a fundamental means of forming a new cultural form: the love of work. (...) Initially, the article discusses how the culture of work is historically founded and then argues against the idealist and postmodern explanations that naturalize it. The argument is based on the understanding that culture has a material basis and is linked to the production and social reproduction of life. Data from the empirical research on child labor in tobacco farming in Brazil and the USA reveal the persistence of the problem among Latino children and families. We conclude with the need to found a new culture for contemporary society, based on other social and economic relations, which allows the working class to free itself from what dominates and exploits it. We discuss how transgenerational communitarianism deals with public decisions involving tradeoffs between different generations’ wellbeing and having global consequences. Policies for tackling climate change are an example. Although there is a natural, evolutionary, basis for intergenerational altruism, most people lack the competencies for constituting a transgenerational community. Moreover, greater attention to future generations’ wellbeing need not substitute for collective action: a lower discount rate reflecting a stronger concern for future generations may even worsen their wellbeing. Finally, in a world of (...) irreducible value pluralism, there is no community of persons sharing moral values that can legitimize common policies for addressing global problems: only the common interest of avoiding destructive consequences may motivate collective action to face problems like climate change. En jetant la sonde de l’interrogation philosophique au lieu de soi, Jean-Luc Marion nous donne une approche organique et originale à la pensée d’Augustin, en entrecroisant entre eux deux plans herméneutiques : sur le premier, l’on poursuit un itinéraire de rapprochement au cœur de la confessio augustinienne permettant de réduire le vaste univers sémantique d’Augustin à un noyau génétique unifiant; sur le second plan, le parcours philosophique de l’auteur se développe ultérieurement, tendant à désarticuler un bloc théorique d’ontologie et métaphysique (...) et atteignant ainsi par une voie phénoménologique une idée de philosophie finalement affranchie de la présupposition du caractère central de la question de l’étant et du fondement. En tout cas, même si l’on ne veut pas donner trop d’éclat à la critique anti-ontologique et antimétaphysique caractérisant l’approche à la pensée augustinienne proposée dans cet ouvrage, l’acquis spéculatif de celle-ci ne semble pas diminuer. Un parmi les mérites principaux de ce livre est d’avoir restitué à la confessio sa dignité théorique, en y apercevant un lieu phénoménologique originaire où la relation entre moi et Dieu se noue; une relation dont le caractère paradoxal, autrement insoutenable, est résolu par le primat du don et de l’amour. This article analyses the use of the term “‘political oeconomy” in the Wealth of Nations, considered by many the founding text of the discipline of Political Economy. It shows that Adam Smith could not accept the use of the term “political oeconomy” that had been made by other authors to indicate the subject matter of his scientific inquiry, devoted to the nature and causes of the wealth of nations; he used the term “political oeconomy” as a synonym for economic policy, (...) especially in the fourth book of the Wealth of Nations. In order to understand this statement, it is necessary to keep in mind the methodological and epistemological perspective developed by Smith; in his view, the inquiry into the nature and causes of the wealth of nations would have to discover the almost unchangeable rules that presided over the choices of the legislators in the field of public economy and in the management of public resources. By contrast, the term “political oeconomy” was used by Smith exactly to indicate the policies really adopted in these fields, policies which frequently altered the system of natural liberty. Substantial evidence supports the perspective that the people of Ancient Greece had a language for and some use for drugs, both for the purpose of medicine and poison; however, the question remains whether Ancient Greek civilization held a concept approximating what we today call drug addiction. This article explores the textual evidence for the use of two drugs, nepenthes and cannabis, in Ancient Greece. While the existence of nepenthes remains in doubt, the use of cannabis is well documented. Either drug (...) or both drugs may have been used in the rites of the Bacchic and Orphic mysteries, which might explain why there are so few references to these drugs in the Ancient Greek literature. Luigi Giussani, a high school religion teacher throughout the 1950s and 1960s, grounded his teachings in the vast body of experience to be found in Christianity's two-thousand-year history. He told his students, “I'm not here to make you adopt the ideas I will give you as your own, but to teach you a method for judging the things I will say.” Throughout his life, education was one of Giussani's primary intellectual interests. He believed that effective education required an adequate (...) background in the Christian tradition, presented within a lived experience that underscored the capacity of the faith to answer universal questions. What he proposed was a process that allowed one to sift through tradition, critically examining it and comparing it against the ultimate criteria for judgment: the desires of the heart. In Giussani's view, the primary concern was to “educate the human heart as God made it.” In The Risk of Education he states that fear leads students to associate this process of criticism with negativity or doubt. Yet, without an education in criticism, students cannot develop conviction. At a time when young people are abandoning the church and questioning the value of faith, Giussani's method of judging and verifying Christianity as an experience seems a necessary intervention. In The Risk of Education he argues that, ultimately, education and the Christian message reveal themselves through human freedom. (shrink)

The relentless exploitation of the earth's resources and technologys boundless growth are a matter of urgent concern. When did this race towards the limitless begin? The Greeks, who shaped the basis of Western thinking, lived in mortal fear of humanity's hidden hunger for the infinite and referred to it as hubris, the one true sin in their moral code. Whoever desired or possessed too much was implacably punished by nemesis, yet the Greeks themselves were to pioneer an unprecedented level of (...) ambition that began to reverse that tabu. If it is true that no culture can truly repudiate its origins, and that gods who are no longer potent can vanish but still leave behind a body of myth which coninues to live and assert itself in modernized garb, then our concern with the limits of growth reflects something more than an awareness of new technological problems - it also brings to light a psychic wound a a feeling of guilt which are infinitely more ancient. Biological ontologies are used to organize, curate, and interpret the vast quantities of data arising from biological experiments. While this works well when using a single ontology, integrating multiple ontologies can be problematic, as they are developed independently, which can lead to incompatibilities. The Open Biological and Biomedical Ontologies Foundry was created to address this by facilitating the development, harmonization, application, and sharing of ontologies, guided by a set of overarching principles. One challenge in reaching these goals was that the (...) OBO principles were not originally encoded in a precise fashion, and interpretation was subjective. Here we show how we have addressed this by formally encoding the OBO principles as operational rules and implementing a suite of automated validation checks and a dashboard for objectively evaluating each ontology’s compliance with each principle. This entailed a substantial effort to curate metadata across all ontologies and to coordinate with individual stakeholders. We have applied these checks across the full OBO suite of ontologies, revealing areas where individual ontologies require changes to conform to our principles. Our work demonstrates how a sizable federated community can be organized and evaluated on objective criteria that help improve overall quality and interoperability, which is vital for the sustenance of the OBO project and towards the overall goals of making data FAIR. Within a one-dimensional spatial framework, we deduce that partiesto go negative’, by blaming alleged insufficiencies of the rival concerning commonly shared values, increase with their ideological proximity. We test our hypothesis by considering the long period of no-cabinet alternation that characterized both Italy and Japan. In particular, we focus on the (spatial) incentives of the Italian Communist Party and of the Japanese Socialist Party to emphasize on a particular topic related to negative campaigning, i.e. political corruption issues. The status of (...) the perennial opposition held by both parties, together with the existence of several political corruption scandals during the period considered, makes the Italian and the Japanese political systems particularly apt to test our hypothesis. In the Critique of Practical Reason, Immanuel Kant provides two different propositions of freedom. According to the first, in the “Analytic of Pure Practical Reason,” freedom establishes the possibility of moral agency—i.e., it is the ratio essendi of the moral law. According to the second, in the “Dialectic of Pure Practical Reason,” freedom is the object of one of the practical postulates (CPrR 246–54; AA 5:132–41). Why should Kant postulate something that has been allegedly established as the ground of moral (...) agency? Does Kant appeal to two different conceptions of freedom? In this paper, I argue that Kant (1) in both cases conceives of freedom as an unconditioned form of causality, and (2) pursues two different aims according to two different but complementary arguments. On the one hand (the practical standpoint), he wants to argue that the causality of freedom is actual, through moral agency, in the domain where the laws of nature also apply. On the other hand (the theoretical standpoint), he is aware that the possibility of achieving the highest good would be compromised if we did not assume, along with the other two postulates, a world in which only the causality of freedom applies. While freedom as the ratio essendi of the moral law is actual, freedom as a postulate is a mere object of belief. (shrink)

Kant’s theory of peace has been reinterpreted under one of the most influential research programs of our times: The so-called democratic peace theory. In particular, the third ingredient of Kant’s “recipe” for peace —the cosmopolitan right to visit—has been recognized as a powerful and effective instrument to reduce militarized interstate conflicts. In the hands of political scientists, however, this ingredient has often become nothing more than a set of rules for securing and facilitating international trade and economic interdependence. This article (...) argues that this narrow reading mistakes international trade as the essence of the third definitive article. Kant sees economic interdependence as a means to realize what cosmopolitan right is truly about, that is, the affirmation of a set of rules for protecting humans qua humans, the creation of communal bonds among individuals beyond national or group loyalties, and the promotion of a global moral conscience modeled on the natural rights of man. Nem. 3.35–6 ποντίαν Θέτιν κατέμαρψεν | ἐγκονητί (‘[Peleus] caught the sea-nymph Thetis quickly’) is not the original text of Pindar; (b) ἐγκονητί does not fit the context, is not an attested Greek word and should be eliminated from dictionaries of ancient Greek; (c) Byzantine etymological works, followed by many modern scholars, base their explanations on the late antique form ἀκονητί, which should be eliminated from classical, Hellenistic and imperial texts; (d) (...) the tradition of the Etymologicum Magnum knows the variant ἐγκονιτί (conjectured for Pindar by Bergk) ‘with dust’ (‘with effort’), which seems presupposed by the scholia on Pindar; (e) the form ἐγκονιτί (created on the pattern of ἀκονιτί) is to be preferred in Pindar for reasons of language and content and should be added to the dictionaries of ancient Greek. Simple assumptions represent a decisive reason to prefer one theory to another in everyday scientific praxis. But this praxis has little philosophical justification, since there exist many notions of simplicity, and those that can be defined precisely strongly depend on the language in which the theory is formulated. The language dependence is a natural feature—to some extent—but it is also believed to be a fatal problem, because, according to a common general argument, the simplicity of a theory is always trivial (...) in a suitably chosen language. But, this trivialization argument is typically either applied to toy-models of scientific theories or applied with little regard for the empirical content of the theory. This paper shows that the trivialization argument fails, when one considers realistic theories and requires their empirical content to be preserved . In fact, the concepts that enable a very simple formulation, are not necessarily measurable, in general. Moreover, the inspection of a theory describing a chaotic billiard shows that precisely those concepts that naturally make the theory extremely simple are provably not measurable. This suggests that—whenever a theory possesses sufficiently complex consequences—the constraint of measurability prevents too simple formulations in any language. This explains why the scientists often regard their assessments of simplicity as largely unambiguous. In order to reveal a cultural bias in the scientists’ assessment, one should explicitly identify different characterizations of simplicity of the assumptions that lead to different theory selections. In lieu of an abstract, here is a brief excerpt of the content:85, LEGAL OBLIGATION IN HUME There is one aspect of the thought of David Hume that seems to me to be important and topical, especially if considered in relation to two reductionist and dogmatic tendencies that are still noticeable in the general theory of law. By dogmatic I understand conceptions that are insufficiently founded on experience. The first of these two dogmatic tendencies is the emphasis placed on the (...) notion of sanction which is viewed by some as prevailing over the concept of obligation to the point of absorbing it within itself. Law is that which the superior bodies of the dominant class impose. This doctrine has been affirmed even recently. But the master example is given by Bentham. To say that a man has the obligation to behave in a certain way is equivalent to saying that if he does not behave so, he will experience pain (or the absence of pleasure). Legal sanction is the source from which this pain comes. Thus Bentham goes so far as to say that pain is constitutive of 2 obligation in all its forms. This seems to be contrary to experience and common sense. In fact, one can observe a legal obligation independently of the consideration of the consequences inherent in its violation. For this and other reasons the doctrinal tendency to give prevalence to the notion of sanction over the notion of obligation does not take account of experience and is dogmatic. Against this dogmatism one observes even today that the concept of an obligation that arises from a constriction, the concept 3 of Zwangspflicht, is a contradictio in adjecto. Nevertheless, in order to avoid the contradiction inherent in the prevalence of sanction over obligation and the dependence of law on political power and on the power of those who command, it is easy to fall into a second and opposite dogmatism. This second dogmatism consists in affirming the existence of fundamental legal obligations deducible from a priori principles understood platonically 86. as Ol·(fO- T"*) WVXt\S and as vision of the mind. But demonstrative reason, so understood, is determined exclusively through relations of ideas which, in Hume's opinion, cannot themselves constitute legal obligation. A legal system requires modifications and limitations to the passions and interests of individuals. As is well known, Hume argues that a passion and an interest cannot be modified by selfevident rational principles. No criterion that is deducible from demonstrative reason can function as a guide to human behaviour. Now between the two dogmatisms to which I have referred, Hume represents a third way on the basis of experience and of common sense. The advantage offered by Hume's thought is that of showing both the distinction between and the complementary nature of legal obligation and sanction. In what follows I shall discuss what I consider to be the kernel of Hume's legal theory as contained in his conception of human nature, setting aside secondary elements that do not directly concern the subject proposed. First: A legal system is not conceivable without setting up fundamental legal rules which, in Hume's opinion are the rules of justice. Consequently, the discussion of law implies the discussion of justice. And the discussion of justice is part of legal theory. Here I restrict my consideration to the obligations that are expressed by fundamental legal rules which are: stability of possession transference of possession by consent, and performance of promises. We know that, according to Hume, such rules cannot be derived from demonstrative or a_ priori reason but are revealed to empirical knowledge. Second: Hume distinguishes between the setting up of legal obligation and the moral evaluation of the legal obligation. In order to grasp the peculiarity of legal obligation as compared with moral evaluation, I refer here to the constitution of legal obligation. In order to understand the third book of the Treatise, it is in my 87. opinion absolutely necessary to take into account the distinction between the setting up of the legal obligation and its moral evaluation. The printed images in the frontispiece of modern philosophical books were not simply meant as decorations, but offered in remarkable cases a pictorial synthesis of the ideas expounded in the book. This is true not only of Bacon’s Instauratio magna, on the background of an explicit theoretical reflection on the use of fables and metaphors in the exposition of scientific truth, but also of Hobbes’ Leviathan, notwithstanding Hobbes’ own criticism of metaphorical language. One third impressive example is the “dipintura” of (...) Vico’s La Scienza Nuova, which is the object of a lengthy hermeneutical analysis by the author himself. Game-based approaches are emerging in many fields, such as education, social sciences, marketing and government. Most studies debate its role in consolidating learning, guided by both internal and external rewards. These approaches are also being applied in rehabilitation, where patients must undergo a re-learning process of motor gestures after an injury to a body structure. In physiotherapy, much importance is given to analytical-functional movement aspects, but less to the recovery of the complete experience, including motivation, perception, and emotional experience of (...) the patient during the process. The aim of this narrative review is to investigate the role of subjective experience in the application of gamification in physiotherapy, considering the added value it provides to recovery by involving neural structures, not just motor functions. By analyzing the most investigated aspects in using gamification in rehabilitation, we will outline the primary methods of investigation into the engagement and emotions involved in the process. Through a selection of scientific articles found on main databases, we identified articles investigating the patient’s experience. The analysis of these articles was based on aspects related to the recovery of movement, the technology used, as well as the methods of investigation and collection of qualitative data regarding the emotions and perceptions of patients during the gamification experience. The results are divided into two primary topics. Overall, this review supports the idea that gamification could represent a rehabilitation approach integrating physiotherapy, more suitable for the final stages of recovery, such as returning to work or sports.
